How F&O Income Is Classified for Tax in India
Indian tax law treats different trading activities as different kinds of income. F&O is generally treated as non-speculative business income, intraday equity as speculative business income, and delivery-based equity as capital gains. The classification determines the reporting route.
How to read it
- F&O being business income rather than capital gains is the distinction that surprises most people, and it changes which form applies and what can be set off.
- Intraday equity is treated as speculative business income, which is a separate category again with its own set-off restrictions.
- Business income is generally reported through ITR-3 rather than the simpler forms used for salary and capital gains.
Why turnover is the figure people get wrong
For F&O, turnover is not contract value. Under the method the ICAI has described, it is computed from the absolute sum of profits and losses rather than the notional value of the contracts traded. A trader with ₹4 crore of notional contract value across a year may have F&O turnover of a few lakh. Confusing the two inflates the reported figure enormously and can trigger audit considerations that would not otherwise arise. Our separate guide at /blog/fno-turnover-calculation works through the ICAI method with a full example.
What it does not tell you
- Thresholds for tax audit, presumptive taxation and rates are set by statute and revised in budgets. Any figure quoted here would date, so none is quoted — check the current position.
- Set-off and carry-forward rules differ between speculative and non-speculative losses, and the details matter for anyone with both.
- This page describes classification mechanics only. It is not tax advice, and individual circumstances change the answer.
Frequently asked questions
Is F&O income business income or capital gains?
F&O is generally treated as non-speculative business income rather than capital gains. That classification affects which return form applies and how losses may be set off.
Which ITR form applies to F&O trading?
Business income is generally reported through ITR-3. The correct form for your situation depends on your full income profile and should be confirmed with a qualified professional.
How is F&O turnover calculated?
Not as contract value. The widely used method computes it from the absolute sum of profits and losses. Our separate guide walks through the calculation with a worked example.
Do I need a tax audit for F&O trading?
Audit applicability depends on turnover, profit declared and other statutory thresholds that are revised periodically. This is precisely the kind of question to put to a chartered accountant rather than resolve from an article.
